There is nothing codified in Oregon law about carpet wear and tear. If taken to court, the judge would decide what is "ordinary wear and tear.
On the other hand, if it is newer and there is damage, charge them for the undepreciated amount and replace it. These items have a life expectancy. What your tenants are referring to is the life expectancy of the carpet and, yes, as a responsible landlord, you should be replacing the carpet at the end of the carpets life span. Now having said that, because there are a variety of carpets and because there are so many variations to consider, the life expectancy will vary.
However, a 'family home' carpet should have a life expectancy of 10 years, and apartments and rental units will be between 5 and 10 years. Landlords should know and use the life expectancy value to determine depreciation, not only to account for their taxes each year, but when calculating damages, if any, at move out. My carpet is totally messed up. From kids eating, spilling crap on the floor. Its so bad zerorez couldnt fix it. Ive been at my place for almost 5 years now. The key is "ordinary wear and tear". Yes, that's up for some interpretation. That said, "kids eating, spilling crap on the floor" is not ordinary.
Yes, 5 years of use will show definite signs of ordinary wear and tear. Therefore, you get into some gray area. I'd check out your move in inspection checklists as well to see if any mention was made about condition at that time. Take lots of pictures and consider talking to the landlord up front.
You could go to court or look into a tenant advocacy group if you don't get the resolution you think is fair. That's a very large expense I'd rather avoid. Before renting my home, I had lived there with my two dogs. When I moved out I shampooed the carpets myself. The tenants who moved in knew full well that I had two dogs prior to them moving in. Now, the wife became pregnant and is asking, due to allergies, that I have the ducts cleaned and the carpets professionally cleaned -on my dime. Am I financially responsible to have this done?

Will a good tenant stay another year if you professionally clean the carpets and ducts? If none of that matters, then you have no issues. The tenants didn't complaint in the starting and moreover they knew that there were dogs. They accepted the house in that condition only now they are having issues regarding the carpet. This request should be done by them at an early stage during the time when they were taking the possession.

Follow Us. March 18, April 17, I am not sure about Nevada but in Texas a landlord is not required to clean the carpets. It is up to the tenant to have the carpets cleaned if it needs it after they have moved in and lived there. I don't know why any state would require a landlord to clean the carpets. Unless you state in the lease that your tenant will sign that you will clean carpet, you don't have to at all. You can require your tenant to shampoo carpet every six months or as often as you choose.
Do a walk through inspection every three months and see what kind of housekeepers your tenants are. If you see dirty carpet, give them 10 days to clean it.
I am a landlord. I clean carpet when a tenant moves out unless they have already done so. If they don't I charge it against their security deposit. Tenant is required to keep the carpet clean. If tenant needs to have it professionally cleaned, tenant may obtain an estimate, ask for permission of the landlord to do it at tenant's expense. Landlords are not required to clean carpets EVER. If you are thinking that your landlord must shampoo your carpets when YOU live there, think again.
What would be next? Would you want the landlord to also come in to mop your kitchen floors and clean your toilets? Not unless the landlord agrees to do it in the lease. Otherwise, I doubt there is a law that says the landlord is required to do so.
Most apartments who clean carpets annually usually do so as a courtesy service. At the community I run we clean the carpets annually as a courtesy for renewing your lease.
